DISCLAIMER/TERMS AND CONDITIONS – WHITE SANDS BEACH RESORT & SPA

Please read this brief guide to the terms and conditions of staying at White Sands Beach Resort & Spa as well as the terms and conditions for the usage of our internet site. Please allow up to 4 hours notice prior to your expected arrival for online bookings to be processed.

In these General Terms of Business, the following words shall mean:-

  • 1. INTERPRETATION
  • 1.1. In these General terms of business, the following words shall mean:-
  • White Sands – White Sands Beach Resort & Spa;
  • Client – the person, firm or company making a booking or staying at White Sands;
  • Company – means White Sands Beach Resort & Spa;
  • 2. APPLICATION OF TERMS
  • 2.1. These terms apply to all bookings to the exclusion of all other terms and conditions except to the extent that the specific terms apply for a particular booking and have been signed in writing by an Authorized Representative of the Company.
  • 2.2. Confirmation of a booking by the Client is deemed acceptance of these terms.
  • 2.3. The term Client and Guest shall be used interchangeably in the Terms of Business and reference to any one of them shall be deemed to include reference to the other.
  • 3. PRICES
  • 3.1. All published prices include VAT at the current rate.
  • 3.2. White Sands reserves the right to alter prices for any reason up to the date of booking or up to 12 weeks prior to arrival, whichever is the latter.
  • 3.3. After such dates, prices may only be altered to reflect a change in the rate of VAT or for any other reason outside of the control of White Sands, in which case the changes will be notified to the Client. In the latter event, the client may cancel the booking without cost.
  • 4. AVAILABILITY
  • 4.1. All rooms and prices offered by White Sands are subject to availability and the discretion of the Management of White Sands.
  • 4.2. Limited numbers of suitable rooms may be allocated to individual rates, packages or promotions and, when these allocations are taken up, remaining available rooms may be offered to the client at a higher price where the Client requires such rooms.
  • 5. BOOKINGS
  • 5.1. Bookings must be guaranteed for the first night’s accommodation by a major credit or debit card, by payment of a deposit or by agreement in writing with a company, travel agent or hotel booking agency. At the discretion of White Sands, full prepayment may be required. At least 3 working days are required to process credit and debit card payments and 5 working days to process cheque payments.
  • 6. RESERVATION POLICY
  • 6.1 In order to guarantee and confirm your reservation a 75% deposit would be required 72 hours prior to booking date.
  • 6.2 White Sands Beach Resort and Spa reserves the right to release any requested accommodation if the booking is not guaranteed and confirmed within the allowable time period.
  • 6.3 Check-In time is 2:00 pm.
  • 6.4 Check-Out time is 12 noon.
  • 6.5 SUITE is for occupancy of maximum 2 adults and 1 kid.
  • 6.6 SINGLE CHALET is for occupancy of maximum 2 adults.
  • 6.7 DOUBLE CHALET is for occupancy of maximum 4 people.
  • 6.8 VILLA is for occupancy of maximum 6 people.
  • 6.9 No children can be accommodated in the Chalets.
  • 6.10 A 100% payment should be settled upon arrival for Walk-In Guest.
  • 6.11 Early Check-In (from 6:00 am to 1:00 pm) or Late Check-Out (from 1:00 pm to 7:00 pm) will attract a surcharge equal to 10% of the room rate per hour
  • CANCELLATION POLICY
  • 6.12 A surcharge of 50% for Under-Stay Guest (Guest who checks out before departure date).
  • 6.13 A surcharge of 100% of total booked nights for NO- SHOW.
  • 6.14 A cancellation received;
    * 24 hours prior to the date of arrival will be subject to 100% cancellation fee of the total booked nights.
    * 2 days to 1 week prior to the date of arrival will be subject to 50% cancellation fee of the total booked nights.
  • 6.15 A surcharge of 50% of the total room rate for any amendments e.g. change of arrival date, change of guest name, and change of the actual head count before the expected arrival date.
  • 7. DISCLAIMER
  • 7.1 White Sands Beach Resort and Spa does not accept any responsibility and liability;
  • 7.2 To any loss or damage to the property or possession of any guests, their employees, representatives, or invitees, and visitors, whether such damage was caused by fire, theft, or otherwise or by negligence on the wrong act of anyone in the employment of, or acting on behalf of White Sands Beach Resort and Spa.
  • 7.3 Any personal injuries, death or whatever nature, sustained by a guest, resident, or visitor whether sustained by negligence or wrongful act of anyone employed by White Sands Beach Resort and Spa or any other person, or by defective functioning of any apparatus or appliance of White Sands Beach Resort and Spa.
  • 7.4 All valuables including cash, credit card, personal documents (passports, ID cards etc.), jewelry must be kept at all times in the hotel safe provided. Larger items can be kept in the hotel safe at Reception for safe keeping.
  • 7.5 White Sands Beach Resort and Spa is not to be held liable if items not deposited in the appropriate safe are missing.
  • 7.6 Guests must settle their bills/ outstanding balance upon check- out unless previously arranged with management.
  • 7.7 Payment with PARTIAL or in FULL implicates your acceptance of the terms and conditions as well as the DISCLAIMER specified herein.
  • 8. PAYMENT
  • 8.1. Settlement of the bill in full, less any advance payments, must be made prior to departure from White Sands.
  • 8.2. Upon arrival, White Sands reserves the right to request for pre-authorization of the Client’s credit or debit card or, where payment is to be by cash, request the client to place cash up to an amount of 1.5 times the room rate multiplied by the number of nights booked.
  • 8.3. All major credit and debit cards are accepted. Personal cheques may be accepted. Company cheques are not accepted without prior clearance. Accounts may only be forwarded for payment on completion by the Client and formal acceptance by the Hotel of an application for credit facilities, which may be withdrawn at any time. Credit facilities are not offered to private individuals.
  • 8.4. All sums are due for payment on presentation of the invoice. In the event of any query relating to the invoice, the Client must notify White Sands within 7 days of the invoice date and the Client’s obligation to pay all outstanding balances immediately will not be affected.
  • 8.5. White Sands may charge interest at a rate the prevailing commercial bank interest rate on any outstanding balance before and after every judgment.
  • 9. CHILDREN
  • 9.1. Children aged 15 years and under must be accompanied by a responsible adult at all times to ensure that the children’s behavior is appropriate for other guests within White Sands.
  • 9.2. At the discretion of White Sands, children may be excluded from certain events or promotions where deemed unsuitable or inappropriate.
  • Families with kids are allowed for Suite, family house, and Villa accommodations only.
  • 9.3 A suite can have only one extra bed.
  • 9.4 Children over 18 years old are required to book separately.
  • 9.5 Additional beds cannot be accommodated due to room logistics.
  • 10. DOGS AND OTHER PETS
  • 10.1. White Sands does not accept pets.
  • 11. BEHAVIOUR
  • 11.1. White Sands reserves the right to judge acceptable levels of noise or behavior of Clients, Guests or representatives, who must take all steps for corrective action as requested by White Sands.
  • 11.2. In the event of failure to comply with management requests, White Sands may terminate the booking, stop any event immediately and/or ask the Client to vacate White Sands premises immediately without being liable for any refund or compensation.
  • 11.3. All bedrooms at White Sands have been designated non-smoking. Should you choose to smoke in your room, White Sands reserves the right to charge you to cover the cost of cleaning room and for the disruption caused.
  • 12. RIGHT OF REFUSAL
  • 12.1. White Sands reserves the right to refuse a Client, Guest or representative entry and accommodation if, on arrival, management reasonably considers that the guest is under the influence of drink or drugs, is unsuitably dressed or is behaving in a threatening, abusive or otherwise unacceptable manner.
  • 13. DISCRIMINATION
  • 13.1. It is the policy of White Sands to not discriminate on the grounds of race, colour, nationality, religion, sex, marital status, age, ethnic origin or disability.
  • 13.2. Clients, their employees, guests and all sub-contractors engaged by or on behalf of the Client are expected to adhere to this policy and White Sands may, without incurring any liability to the Client, remove from White Sands any person or persons offending against this policy.
  • 14. EXTERNAL PURCHASES
  • 14.1. No wines, spirits, beers or food may be brought into White Sands by Clients, their guests or representatives for consumption or sale on the premises without the express written consent of White Sands and for which a charge may be made by White Sands.
  • 15. COMMENTS AND COMPLAINTS
  • 15.1. Any comments or complaints regarding White Sands should be made to the General Manager at the time of visit so that the matter can be resolved immediately. Alternatively, write within 7 days to White Sands General Manager. Under no circumstance whatsoever, should any complaints in any manner or form be made in respect of White Sands publicly and or in any social media fora.
  • 16. STATUTORY REQUIREMENTS
  • 16.1. White Sands is subject to statutory controls, including those relating to fire, licensing, entertainment, health, hygiene and safety. These must be strictly observed by Clients, their guests and representatives.
  • 17. LIABILITY
  • 17.1. Other than for death or personal injury caused by the negligence of White Sands, White Sands liability to the client is limited to the price of booking.
  • 17.2. Unless White Sands is liable under the above condition 17.1, the Client indemnifies White Sands from and against any and all liability and any claims, proceedings or damages resulting or arising from the booking, event or function, the Client, guests or any outside contractors of the Client.
  • 17.3. White Sands will not be liable for failure to perform to the extent that the failure is caused by any factor beyond its reasonable control.
  • 17.4. White Sands does not accept any responsibility/liability for the Clients personal property nor those of its guests, employees, representatives, invitees or contractors including gifts, presents, seminar, conference, exhibition or other corporate presentation material or such other items brought by the Client, its employees, Guests, representatives, invitees or contractors to White Sands (cumulatively referred to as the clients property). White Sands may, at the request of the Client, provide personnel to assist in carrying, directing, placing, installing or setting up (as the case may be) the clients property. White Sands will not assume custody or control of such articles, which remain on White Sands premises at the owners risk. In such an instance, the Client acknowledges and accepts that the Client shall remain responsible for the Client’s property and shall not hold White Sands liable in any manner whatsoever.
  • 17.5. The Cleint is responsible for damages caused to the allocated rooms etc, its furnishings, utensils, fixtures and fittings and equipment in such rooms by any act, omission, default or neglect of the Client, its guests, employees, representatives, invitees or contractors and shall pay to White Sands on demand the amount required to make good or remedy any such damage.
  • 17.6. Clients should ensure that valuables are covered by the Client’s own insurance policy.
  • 17.7. Clients must report any loss or damage to their property immediately on discovery to White Sands Management, and shall make themselves available to assist with any reports made by White Sands to the police.
  • 17.8. Clients shall not enter areas of White Sands which are indicated as being closed to the public. White Sands shall not be responsible for death, personal injury or loss or damage to property suffered by a Client and their guests in such areas.
  • 18. THIRD PARTY LIABILITY
  • 18.1. White Sands does not accept any liability for services rendered by third parties to Clients notwithstanding that such services may be arranged by White Sands.
  • 18.2. Any claim, demand, charge, suit or damages which may be incurred by the Client or their guests (or any person claiming thereunder) shall be made directly with such third parties and the hotel shall render all reasonable assistance in this regard.
  • 19. INSURANCE
  • 19.1. The Client is recommended to have and is responsible for insurance to cover cancellation, curtailment, and loss of baggage, personal effects and money.
  • 20. DATA PROTECTION
  • 20.1. The information provided by the Client may be processed White Sands for the purposes it shall notify to the Data Protection Registrar By confirming the booking, the Client consents to this processing of the information.
  • 21. DISPUTE
  • 21.1. These terms shall be construed in accordance with Ghanaian Law and White Sands & Client shall both submit to the exclusive jurisdiction of the Ghanaian courts.
  • 22. INTERNET FACILITIES
  • 22.1. Internet facilities are provided by third party providers. Where these facilities are available in White Sands, the Client acknowledges that there may be disruption to the connection without prior notice and White Sands shall not be liable whatsoever for such disruption. The Client further undertakes not to use the facility for any fraudulent purpose or in connection with any criminal offence and in contravention of any license and will indemnify White Sands against any claim, demand, suit proceeding or prosecution arising therefrom.
  • 23. WEBSITE INFORMATION
  • 23.1. White Sands cannot accept responsibility for any errors or omissions and reserves the right to cancel, amend or vary the arrangements featured in the site without notice.
  • 24. ACCESSIBILITY
  • 24.1. White Sands is committed to improving accessibility for all customers within our hotel and users of our internet site.
  • 25. COPYRIGHT
  • 25.1. The information provided herein is provided in good faith. The usage of any information from this website is entirely at the risk of the user.
  • 26. INTERNET SITE SECURITY
  • 26.1. Booking on line through our internet site is safe. Our online reservation system is secure and your credit card information will be encrypted.
  • 27. OTHER POLICY
  • 27.1 Membership rates applicable to member only & in NO way are transferable.
  • 27.2 A corkage fee of 40% off the menu price per bottle applied to all beverage items. Food items are restricted to be brought inside White Sands Beach Resort and Spa.
  • 27.3 No pets allowed within the hotel premises.
  • 27.4 Dress Code- Casual attire, at Yellow Fin Restaurant (Signature Restaurant) and Touch of Africa Bar. No shorts, No swim suit, No T-shirt policy.
  • 27.5 Souvenir, Jewellery by Charles Greig, and boutique items available at the Pebble Shop.
